An Operator's Licence is now required by any person who is involved in the business of carrying passengers by road for hire or reward and the vehicle used may carry more than 8 passengers in addition to the driver.
An Operator can be any person suitably qualified to operate road passenger transport operations, either locally or internationally. It is the person and not the vehicle that qualifies for an Operator's Licence.
An Operator's Licence may be issued either as a National Operator's Licence, allowing an operator to carry passengers but only in Malta; or as an International Operator's Licence ,allowing an operator to carry passengers both locally and internationally. The holder of an International Operator's Licence automatically qualifies for a Community Licence which allows operators to operate freely within the European Union, including limited cabotage services in the same country.
Each Operator's Licence lists the number of vehicles licensed under that particular licence.
An Operator’s Licence is specifically issued to a named person and cannot be sold, transferred or passed on to family members.
Where an Operator is unable to continue performing his/her duties due to illness, death or other mitigating circumstances, the Authority may permit the carrying on of the passenger transport operation on a temporary basis for a maximum period of 9 months.
The person holding the Operator’s Licence is legally responsible and personally liable for every aspect concerning the licence and for ensuring that operations are conducted as required by the relevant regulations in force at the time. Therefore, the decision to apply for an Operator’s Licence must not be taken lightly because of the level of responsibility involved.
